Algemene voorwaarden
1.1. These general terms and conditions apply to all reservation requests and agreements concluded, directly or indirectly, with De Wadden Ameland rental & management and relate to all types of accommodation rented by us.
1.2. The Wadden Ameland rental &camp; management explicitly rejects the application of other general conditions.
1.3. Exceptions to these general terms and conditions are only possible if the parties have agreed to them in writing.
Reservation
2.1 The Wadden Ameland rental &camp; management only accepts reservation requests from persons 24 years and older. De Wadden Ameland rental & management reserves the right to refuse a reservation request, without giving further reasons.
2.2 The agreement between De Wadden Ameland rental & management and tenant comes into effect at the moment that the reservation confirmation – also being the invoice – has been sent to you by post or by email.
2.3 Tenant must check the reservation confirmation for accuracy. Inaccuracies must be immediately passed on to De Wadden Ameland rental & management.
2.4 Tenant shall make a (partial) payment to De Wadden Ameland rental & management within the period specified in the reservation confirmation. The Wadden Ameland rental & management is entitled to consider the agreement as not concluded, if the Wadden Ameland rental & management does not receive the agreed (partial) payment within the set term. In that case, the Wadden Ameland rental & management has the option to release the reserved accommodation for rental to others without further notice to the tenant and to charge the tenant for cancellation costs.
Modifications to the reservation
3.1 De Wadden Ameland rental & management is not obliged, after the conclusion of the agreement, to make changes to the agreement at the request of the tenant.
3.2 If De Wadden Ameland rental & management makes a change, De Wadden Ameland rental & management has the right to charge the tenant a change fee, which shall be at least € 15,- per change.
Prices
4.1 Tenant owes De Wadden Ameland rental & management the agreed rental price, as stated on the reservation confirmation.
4.2 The prices and additional costs are listed for each property on the property website in the price list.
4.3 Unforeseen, government-imposed price increases may be passed on
Payment
5.1 Tenant must pay a deposit consisting of fifty percent (50%) of the rental amount within seven (7) days of reservation . Two (2) months prior to arrival date Tenant shall pay the remaining fifty percent (50%) of the rent.
5.2 If a reservation is made two (2) months or less prior to arrival date, the entire amount in accordance with the reservation confirmation shall be paid by Tenant to De wadden Ameland rental & management within eight (8) days after reservation.
5.3 Tenant is not entitled to (partial) refund of the travel sum, if tenant departs before the agreed departure date.
5.4 The Wadden Ameland rental & management has the right to cancel the reservation and to release the accommodation for rental to others without further notice to tenant, if a payment term has expired and tenant has not fulfilled his obligations.
5.5 De Wadden Ameland rental & management has the right to dissolve the agreement without notice of default or court intervention being required, if:|
– at the start of the rental period, the total rental sum has not been paid;
– tenant leaves the rented property prematurely;
– tenant fails to occupy the rented property on the day of commencement of the rental period before 20.00 hours, without having informed De Wadden Ameland rental & management in time that the rented property will be occupied later than the rental period.
Change days
6.1 Arrival and departure is possible on , Friday unless otherwise stated on the site. The Wadden Ameland rental & management specifies the day of arrival on the reservation confirmation.
6.2 The arrival and departure times may varyëren per property. As a rule, the tenant can occupy the rented property on the day of arrival from 15:00 and the tenant must leave the rented property on the day of departure before 10:00. Deviating arrival and departure times are indicated on the booking confirmation.
Deposit must be paid at the time of booking.
7.1 Tenant will pay in cash on arrival any costs for bed, bath and kitchen linen, cleaning costs. Unless otherwise agreed
7.2 The deposit serves as security for any damage caused by tenant to the rented property during the rental period will be deducted from the deposit. Also extra costs, such as extra cleaning costs due to excessive pollution, can be deducted from the deposit. If the deposit is not sufficient to cover the damages and costs, the additional damages and costs will beïncollected from the tenant afterwards.
7.4 The amount of the deposit can varyëren, depending on the accommodation and the duration of the stay.
(Household) regulations
8.1 Guests must comply with the rules established by The Wadden Ameland rental & management. De Wadden Ameland rental & management has the right to immediately remove the tenant and his travelling companions from the accommodation, if the household rules are violated and/or instructions are not followed. Tenant is in that case not entitled to restitution of (a part of) the rent.
8.2 De Wadden Ameland rental & management reserves the right to request the tenant to present a valid proof of identity when checking in. The Wadden Ameland rental &camp; management is entitled to refuse tenants, who cannot identify themselves, access to the rented accommodation.
8.3. The tenant will allow that during the rental period necessary maintenance will take place on the rented property. Tenant cannot claim any compensation. The necessity of the maintenance is at the discretion of De Wadden Ameland rental& management. The tenant will also allow work to be carried out on the park's facilities during the stay (if any)
8.4 The tenant shall use the rented property exclusively as a vacation accommodation.
8.5 The rented property will be made available to the tenant by handing over the keys. The keys will not be handed over until the full rent and all additional costs have been received by De Wadden Ameland rental & management. The tenant shall leave the accommodation before 10.00 on the agreed date of departure and return the keys to the agreed place agreed upon in writing. The property must be left broom clean, the dishwasher (if present) empty and the garbage cans also empty. Any rented bed linen must be put down in the hall.
8.6 De Wadden Ameland rental &management obliges itself to deliver the rented property clean and in good condition to tenant at the agreed time.
8.7 The use of bed linen is mandatory. The tenant is obliged to rent them from De Wadden Ameland verhuur & beheer.
8.8 The tenant must always allow employees of De Wadden Ameland verhuur & beheer direct access to the rented property.
8.9 The tenant may not assign the rented property to third parties for rent and/or use, nor allow more persons to stay overnight in it than indicated at the time of reservation and specified on the reservation confirmation. De Wadden Ameland rental & management has the right to dissolve the agreement immediately and without judicial intervention, if it finds that the agreed number of persons in the accommodation has been exceeded.
8.10 Tenant is obliged to treat the rented property and its inventory with care. The tenant shall leave the rented property in orderly and broom clean condition upon departure. All damage caused by or because of tenant or his co-users to the rented property must be reported by tenant before departure to De Wadden Ameland rental & management and will be paid immediately. All damages resulting from neglect of this obligation by tenant will be charged to tenant by De Wadden Ameland rental & management.
8.12 It is not allowed to use in the rented property other appliances for cooking and washing purposes, than those provided by De wadden Ameland rental & management.
Pets
9.1 De Wadden Ameland rental & management has separately stated in the price list whether the tenant may bring pets and if so, how many pets are allowed per accommodation.
9.2 Tenant must indicate at the time of booking whether he wishes to bring pets.
9.3 Tenant must follow any instructions on bringing a pet. Pets must be kept on a leash and must not be a nuisance.
Force majeure
10.1 The Wadden Ameland rental &camp; management is not liable if the rented property is not available due to force majeure and/or other circumstances. Tenant will never be able to sue De wadden Ameland rental & management in that case.
Liability
11.1 De Wadden Ameland rental&camp; management accepts no liability for theft and loss of or damage to property or persons of any kind during or as a result of a stay at De wadden Ameland rental &camp; management
11.2 De Wadden Ameland rental & management accepts no liability for the fact that tenant's stay with De Wadden Ameland rental & management does not meet expectations that tenant had thereof.
11.3 De Wadden Ameland rental & management accepts no liability for damage or injury caused to property or persons as a result of staying on the premises of the rented property or caused by the use of the facilities provided on the premises ( e.g. toys)
11.4 De Wadden Ameland rental & management is not liable for damage claims arising from noise nuisance caused by third parties.
11.5 De Wadden Ameland rental & management is not liable for damage arising from information provided by its employees by mouth or by telephone.
11.6 De Wadden Ameland rental & management is not liable for the disablement and/or disuse of facilities and/or amenities.
11.7 Tenant and his travelling companions are jointly and severally liable for all loss and/or damage to the rented property and other property of De Wadden Ameland rental & management, arising during the rental period. 11.8 The tenant is obliged to pay all extra costs, which arise as a result of not properly using or not properly leaving the rented property. This provision includes, but is not limited to, leaving excessive dirt behind. These extra costs can be deducted by De Wadden Ameland rental & management from the deposit.
11.9 Tenant declares to be familiar with the location, furnishing and proper condition of the rented property on the basis of provided (written) information, website, etc.
Complaints
12.1 Despite the care and effort of De Wadden Ameland rental & management, it is possible that you may have a complaint. Complaints should be reported immediately to the landlords. If a complaint cannot be resolved or is not resolved to your satisfaction, you should email the complaint during your stay. The e-mail can be sent within eight (8) days of the departure date to: info@dewaddenameland.nl This course of action is absolutely necessary in order for the complaint to be handled properly.
12.2 All agreements between tenant and De Wadden Ameland rental & management shall be governed by Dutch law.
Cancellation conditions
13.1 The following cancellation rates apply to all bookings. The fees payable by tenant to The wadden Ameland rental & management in the event of cancellations of the total travel sum shall be:
for cancellations more than three months before the arrival date, fifty percent (50%) of the travel sum.
for cancellation within three months before arrival date, seventy-five percent (75%) of the travel sum.
for cancellation within six weeks to the day of arrival, the cancellation fee is one hundred percent (100%) of the travel sum.
13.2 Tenant is advised to take out cancellation insurance. If you rightly invoke your cancellation insurance, the insurer will pay any cancellation fee owed by you to the tenant.
